Virginia State Introduces New Laws Aimed at Reducing Gun Violence

The Commonwealth of Virginia has been on the forefront of national conversation about gun control legislation. Recently, Governor Ralph Northam signed several measures aimed at reducing gun violence in the state. These measures were inspired in part by the 2019 shooting in Virginia Beach that claimed the lives of twelve people.

Universal Background Checks

One of the laws signed into effect mandates that universal background checks be conducted for all gun sales. Previously, private sellers did not have to conduct background checks on buyers. With this new law, all gun sales must go through a licensed firearm dealer who will perform a background check. This ensures that individuals with dangerous backgrounds or past criminal convictions are unable to obtain firearms through private sales.

Red Flag Law

Additionally, Virginia’s red flag law allows law enforcement and other parties to request an emergency protective order from a court. This order prohibits an individual from owning, purchasing, or possessing firearms for a period of time. The law is designed to help prevent individuals who may pose a risk of harming themselves or others from having access to firearms.

Limiting Handgun Purchases

Another new law limits individuals to only one handgun purchase per month. Supporters of the law argue that limiting purchases will cut down on illegal trafficking of firearms. Opponents argue that it infringes on individual rights to purchase firearms.

Strengthened Penalty for Failing to Report Lost/Stolen Guns

Previously, if a firearm was lost or stolen, the owner was required to report it to law enforcement. However, there was no penalty if the owner failed to do so. Under the new law, if an individual fails to report a lost or stolen firearm within 48 hours, they can be charged with a Class 6 felony. This is an effort to crack down on illegal gun sales and trafficking.

Ban on Sale of Assault Weapons and Large-Capacity Magazines

Finally, the most controversial of the new laws is the ban on the sale and possession of assault weapons and large-capacity magazines. This law prohibits the sale, transfer and possession of these weapons and ammunition magazines that can hold more than ten rounds. Supporters argue that these types of guns are designed for military use and have no place in civilian society. Opponents argue that this law infringes on the Second Amendment rights of Virginians and fails to address underlying issues of gun violence.

Overall, Virginia’s new laws aim to reduce gun violence by establishing stricter control over firearm sales, combatting illegal trafficking, and providing opportunities to prevent potentially dangerous individuals from accessing firearms.
